The personal training services by Iron University to Client and Client’s use of any premises, facilities, or equipment are contingent on this Agreement. If Client is under 18 years old Parent or Guardian must review and sign on behalf of client.
ASSUMPTION OF RISKS
Exercise has inherent risks and personal safety cannot be guaranteed by Iron University. Training and using fitness equipment are potentially hazardous activities. These activities involve risks or injury (including but, not limited to, heart attacks, muscle strains, pulls or tears broken bones, shin-splints, heat prostration, knee/lower back/foot injuries or any other injuries occurring during or after participation of physical activities), aggravation or preexisting conditions (known or unknown) and in the most severe and extreme situations death. I agree that if I engage in any physical exercise or activity, including personal training, I do so at my own risk and assume the risk of any and all injury and/or damage that I may suffer, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility or using any equipment, whether provided for me by Iron University or otherwise, including injuries or damages arising out of the negligence of Iron University, whether active or passive, or any Iron University’s affiliates, representatives, and agents. Assumption of risk includes, but is not limited to, use of any exercise equipment, sports fields, courts, or other areas. I assume the risk of participation in any activity, class, instructions, or event including by not limited to weightlifting, walking, jogging, running, aerobic activities, muscular endurance and strength building exercises. I agree that I am voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to my property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Iron University or otherwise.
POTENTIAL BENEFITS
I understand that a regular exercise program has been shown to have definite benefits to general health and well-being. I know that some of the benefits can include loss of weight, reduction of body fat, improvement of blood lipids, lowering of blood pressure, improvement of cardiovascular function, reduction in the risk of heart disease, improved strength and muscular endurance, improved posture, and improved flexibility. Exercise on the body cannot be predicted with complete accuracy.
RELEASE
I agree on behalf of myself (and all my personal representatives, heirs, executors, administrators, agents and assigns) to release and discharge Iron University (and Iron University’s affiliates, representatives, and agents) from any and all claims or causes of action (known or unknown) arising out of negligence of Iron University, whether active or passive, or any of Iron University’s affiliates, representatives, and agents. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (i) any and all use of any exercise equipment or facilities which may malfunction or break, (ii) any and all improper maintenance of any exercise equipment,(iii) negligent instruction or supervision, including personal training (iv) slipping or tripping and falling while on any portion of a premises while traveling to or from person training, including injuries resulting from Iron University’s or anyone else’s negligent inspection or maintenance of the facility or premises (v) medical conditions whether known or unknown to me. I understand that any recommendation for changes in diet including the use of supplements are my responsibility and should consult a doctor prior to undergoing any dietary or food supplement changes.
INDEMNIFICATION
I hereby agree to indemnify and hold harmless Iron University, its respective representatives, executors, agents, and assigns from any and all claims, demands, loss, liability, injury, death, damage, causes of action or cost that I may suffer arising out of participation of personal training and or use of the equipment, including while receiving instruction/or training. I understand that this waiver includes any claims based on negligence, action or inaction of the above parties.
DESCRIPTION OF THE EXERCISE PROGRAM
I understand that the exercise program will involve participation in several types of fitness and instructed activities. These activities will vary depending upon the objectives that Iron University and I establish. It is acknowledged that Iron University offers a service to clients encompassing the entire fitness spectrum. Iron University is not in the business of selling exercise equipment or fitness items such as, but not limited to, food, drink, supplements, vitamins, or other such products to the public, and the use of such items is incidental to the service provided by Iron University.
PARTICIPANT RESPONSIBILITES
I understand that it is my responsibility to (i) fully disclose any health issues or medications that are relevant to participation in a strenuous exercise program; (ii) cease exercise and report promptly any unusual feelings (e.g., chest discomfort, nausea, difficulty breathing, apparent injury) during the exercise program; and (iii) clear my participation with my physician. If I am currently under a physician’s care for an injury, condition, or illness it is strongly recommended to consult my physician before conducting any exercise, using any equipment, or participating in any program.
PARTICIPANT ACKNOWLEDGEMENTS
In agreeing to this exercise program:
• I am at least 18 years old or my parent/guardian has read and signed below
• I acknowledge that my participation is completely voluntary
• I understand the potential physical risks involved in this personal training program
• I give consent to certain physical touching that may be necessary to ensure proper technique and body alignment.
• I understand that the achievement of health or fitness goals cannot be guaranteed.
• I have had a voice in planning and approving the activities selected for my exercise program.
• I have been able to ask questions regarding any concerns I might have, and have had those questions answered to my satisfaction.
• I am in good physical condition, have no impairment which might prevent my participation in such activities, and have been advised to consult with a physician prior to beginning this program.
• I have been advised to cease activity immediately if I experience unusual discomfort and feel the need to stop.
PHOTO RELEASE
Iron University has my permission to use my photograph publicly to promote Iron University. I understand that the images may be used in print publications, online publications, presentations, promotion, illustration, advertising, or trade, in any manner or in any medium. I hereby release Iron University and its legal representatives for all claims and liability relating to said images or videos. I also understand that no royalty fee or other compensation, arising or related to the use of my image or recording, shall become payable to me by reason of such use. By agreeing to these terms I grant permission to the rights of my image, likeness, and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the internet and social media. I have the right to revoke this authorization at any time, if I do so in writing, and address it to Iron University. I understand that the revocation will not apply to any actions already taken as a result of this authorization. I understand that I may refuse to sign this authorization. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio, or video recordings collected as part of the personal training sessions with Iron University.
CANCELLATION POLICY
Cancellation due to weather:
I will contact you if I am cancelling sessions due to bad weather. In most cases, I will still be training clients unless there is a hurricane or other life threatening weather conditions. I will report weather situations and cancellations with ample time before your session. I will make up the session if we cancel due to weather.
Cancellation due to illness:
If you’re sick, please notify me 24 hours in advance. Cancellations made at the last minute will not be excused.
Cancellation for other reasons:
I only accept cancellations if you are sick. I will still have to charge you for the session if you do not show up for your sessions or if you cancel last minute. If you notify me a week to a few days before, we can discuss rescheduling a make up session or meet the following session.
Cancellation due to a religious holiday:
If you’re going to miss a lesson due to a religious holiday, please notify me a full week in advance so I can fill your slot for that week.
Pregnancy:
Permission in a note from your doctor is needed to work out.
Make up sessions:
A make up session must be rescheduled if you had an excused cancellation and I was notified a full week in the appropriate amount of time. You are allowed to have a make up session but it must be scheduled with the next 5 business days otherwise it expires.
Payment:
Payment must be made in packages of 10, 25, or 40. I accept Cash, Venmo, and Checks.
